US Court Mandates Release of Kilmar Abrego Garcia from ICE Detention
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her order.
The situation stems from a erroneous deportation to El Salvador in March, which the government later acknowledged was an error. Following his repatriation to the United States to face human smuggling charges, he was held in federal custody.
In her decision, the judge noted that the government lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
